چکیده
مقاله حاضر درصدد است تا نقش وکلا در نقل و انتقال بین‌المللی در نظام منطقه ای را مورد بررسی و تحلیل قرار دهد؛ وکالت از جمله مهم‌ترین عقودی است که در جامعه امروزی کاربرد دارد، در این بین وکالت دادگستری نوع خاصی از وکالت است که بنا به ماهیت ذاتی آن در کنار دستگاه قضایی جهت تحقق عدالت تلاش می‌نماید. مقاله توصیفی تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی سوال مورد اشاره پرداخته شده است. نتایج تحقیق نشان میدهد که پدیده جهانی شدن، ایجاد دادگاه‌های بین‌المللی، گسترش جرایم بین‌المللی، توسعه صلاحیت کشورها به خارج از مرزها، لزوم همکاری‌های پلیسی و قضایی بین‌المللی، جهانی و بین‌المللی شدن وکالت در امور حقوقی را به یک ضرورت و نیاز تبدیل کرده است، لیکن برای تحقق این ضرورت، فقدان تشکیلات سازمانی برای این موضوع، سیاست‌های امنیت گرای محدود کننده وکلا در کشورها، تفاوت‌های ماهوی و شکلی نظام‌های حقوق و بین‌المللی به عنوان چالش‌های مهمی محسوب می‌گردند که تا زمان حال مانع تحقق این ضرورت شده اند. لیکن بایستی با استفاده از ظرفیت‌های وکلای علاقه مند و اتحادیه بین‌المللی وکلا درکنار ضمانت اجراهای بین‌المللی مرتبط با وکالت در امور حقوقی بهره برد و این ضرورت را جامه عمل پوشاند.

The present article sought to examine the role of attorneys in international transfer in the regional system. Delegation is a commonly used contract in today’s world. Among other things, working as an attorney at law is a special type of delegation where an attorney works alongside the justice system to administer justice. This analytical-descriptive article explored the issue using a library method. Findings showed that universalization, establishment of international courts, increasing international crimes, developing international competence of nations, and the necessity for promoting international police and judicial cooperation are among grounds emphasizing the importance of international delegation in legal affairs. However, a lack of institutional organization, countries’ security-based restrictive policies, as well as substantive and procedural differences in international legal systems have been major obstacles to materialize it. As a result, it is necessary to fulfill this need using the existing capacity of enthusiastic lawyers and international unions for attorneys alongside international sanctions related to advocating for legal affairs.
