Abstract

Environmental crimes have destructive effects on nature and natural resources, which are categorized according to severity, the most important issue is the need to criminalize such crimes against the environment, according to which the relevant norms in These areas can be identified and investigated, in principle, environmental crimes can be definitively reduced when the effects of the importance of such crimes on the internationally perceived international documents point to their destructive nature and humanity. And to be prosecuted by international criminal authorities, which also requires the criminalization of these crimes in the section of major international crimes in the Statute of the only international criminal authority with universal jurisdiction, namely the International Criminal Court. In such circumstances, environmental crimes should be included in the list of identified crimes, such as crimes against humanity and war crimes, so that the Court can pursue them. The research findings are expressed by descriptive-analytical method indicate that the International Criminal Court can classify and prosecute most environmental crimes as war crimes, provided that they occurred during the war, followed by such crimes in the Criminal Court Internationally in accordance with the principle of universal Jurisdiction.
