By Knowing ethics and philosophy based on moral theories one can explore civil responsibility as well as issues of fairness and justice from the perspective of the Holy Quran and general social practices and existing laws in this field . Meanwhile fault has a deep connection with good ethics because good moral criteria can be evaluated in contracts. Studying the types of blame divisions intentional personal and some Kind of moral considerations and the existence of good morals can be the causes of contract cancellation or non implementation. In raising the level of good ethics in the affairs of contracts one can try to realize the creation of good ethics in contracts by understanding the facts and marking substantive inferences. نقش اخلاق حسنه در مسئولیت قراردادی به مهمترین جنبه های اخلاقی در تعهدات و نوشتار طرفین معامله بر اساس کرامت انسانی و انصاف و عدالت و حقوق عامه می پردازد . از سویی گاهی اوقات واژه تقصیر از مبانی مهم مسئولیت مدنی محسوب می شود. بدیهی است موضوع یاد شده مستلزم شناسایی معنای واقعی کلمه اخلاق حسنه در مسئولیت قراردادی باشد. با شناخت اخلاق و فلسفه بر نظریه های اخلاقی، می توان مسئولیت مدنی و همچنین موضوعات انصاف و رعایت عدالت را با نگاه قرآن کریم و رویه های عام اجتماعی و قوانین موجود در این زمینه مورد کاوش قرار داد. در این میان تقصیر پیوند عمیقی با اخلاق حسنه دارد . زیرا می توان معیارهای اخلاقی حسنه را در قراردادها مورد ارزیابی قرار داد . مطالعه انواع تقسیمات تقصیر نیز به عمدی و غیر عمدی، شخصی و نوعی، ملاحظات اخلاقی و وجود اخلاق حسنه می تواند از موجبات ابطال و یا عدم اجرای قرارداد باشد .در اعتلای سطح اخلاق حسنه در امور قراردادها می توان با درک واقعیت ها و استنباط ماهوی در تحقق ایجاد اخلاق حسنه در قراردادها تلاش نمود.
